Summerplace Farm -- Terms of Use
Last revised: February 27, 2003
PLEASE READ OUR TERMS OF USE AGREEMENT CAREFULLY BEFORE YOU BECOME A SUBSCRIPTION MEMBER OF SUMMERPLACE FARM
HORSE SHOW LLC ("Summerplace"). By checking the box indicating your acceptance of this Terms of Use Agreement during
registration, you agree that your subscription to Summerplace is subject to your compliance with the terms and
conditions set forth in this Terms of Use Agreement.
Acceptable Use
Summerplace respects that the Internet provides a forum for free and open discussion and dissemination of
information, however, when there are competing interests at issue, Summerplace reserves the right to take certain
preventative or corrective actions. In order to protect these competing interests, Summerplace has developed an
Acceptable Use Policy ("AUP") intended as a guide to the customer's rights and obligations when utilizing
Summerplace's services.
The following constitute violations of this AUP:
a. Illegal use. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that,
intentionally or unintentionally, violates any applicable local, state, national or international law, or any
rules or regulations promulgated thereunder.
b. Harm to minors. Using the Services to harm, or attempt to harm, minors in any way.
c.Threats. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens
or encourages bodily harm or destruction of property.
d. Harassment. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that
harasses another.
e. Fraudulent activity. Using the Services to make fraudulent offers to sell or buy products, items, or services or
to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters."
f. Forgery or impersonation. Adding, removing or modifying identifying network header information in an effort to
deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other
identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute
impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam
email address collectors is allowed.
g. Copyright or trademark infringement. Using the Services to transmit any material (by email, uploading, posting,
or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any
third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and
distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal
of copyrighted software.
h. Reselling the services. Reselling the Services without Summerplace's authorization.
i. Obscene Speech or Materials -- Using Summerplace's network to advertise, transmit, store, post, display, or
otherwise make available child pornography or obscene speech or material. Summerplace is required by law to notify
law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted
through Summerplace's network.
j. Other Activities -- Engaging in activities, whether lawful or unlawful, that Summerplace determines to be
harmful to its subscribers, operations, reputation, goodwill, or customer relations.
As we have pointed out, the responsibility for avoiding the harmful activities just described rests primarily with
the subscriber. Summerplace will not, as an ordinary practice, monitor the communications of its subscribers to
ensure that they comply with policy or applicable law. When Summerplace becomes aware of harmful activities,
however, it may take any action to stop the harmful activity, including but not limited to, removing information,
shutting down a membership subcription without refund or recourse, implementing screening software designed to
block offending users or take any other action it deems appropriate.
Summerplace also is concerned with the privacy of on-line communications and web sites. In general, the Internet
is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone
service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Summerplace
urges its subscribers to assume that all of their on-line communications are insecure. Summerplace cannot take any
responsibility for the security of information transmitted over Summerplace's facilities.
